"There are hard cases and there are easy cases. This is an easy case. This case is wholly
without merit, both factually and legally."
-- Judge Danny Chin, ruling on FNN's request for a preliminary injunction against Al Franken's new book.

I'm hoping for the rarely-seen fine for filing a frivilous brief.

Yay for "wholly without merit"!

As for the fine, AFAIU(nderstand) it, the way to defend trademark IS to sue whenever there's even a remote possibility of a violation. (Leaving aside the issue of whether or not the mark is ultimately defensible.) But we can hope nonetheless.

Hope you don't mind me popping over, but since I saw your original piece on Fov vs Franken on a friend's page, I was not sure if you heard Fox withdrew the lawsuit - primarily based upon the judge's ruling that Franken's work was a protected parody.

I had not heard they had actually withdrew the lawsuit -- last I'd heard they were considering their options. Cool!
